The law says that a builder or contractor must complete any works to a reasonable standard as per the contract.
If works are left incomplete or have not been completed to a reasonable standard you may be able to bring a claim against the builder for damages or breach of contract or if your builder has brought proceedings over unpaid fees we can help to defend it and look at any counterclaims you may have.
I can help with sensible commercial advice, a robust defence and help from our Barristers in Court.
I am an experienced Barrister dealing with building dispute cases, and our range of experience is from dealing with disputes over building projects that have not been completed to an adequate standard, the contractor has left the site without completing the work to the agreed specification or that monies have been paid for works that have not been completed at all.
The process
The first stage on any building disputes is to obtain a report as to the work that has been completed and not completed and whether that work has been completed to a reasonable standard under the Consumer Rights Act 2015. I have access to a wide range of surveyors who can provide robust and detailed reports in relation to the works and whether they have been completed to the requisite standard and in accordance with the contract.
Thereafter, I can help to send a letter of claim, or if you are defending a claim, we can assist to gather evidence to refute a claim including expert evidence, and send a letter in relation to liability to the other side.
Mediation
Whether I am bringing or defending a claim on behalf of a client, we will always consider alternative options to resolve a dispute such as mediation or arbitration, as well as other cost-effective ways of trying to resolve a dispute without recourse to litigation.
Litigation
However if litigation and court proceedings are necessary, I will bring or defend a claim for you in a robust way but commercially sensitive way to try and resolve a dispute in the most cost-effective way possible.
As my work is on fixed fees so you know exactly what to expect in terms of the work that we will carry out and when and there are no surprising bills at the end of the matter.
